Goode Health (sometimes referred to as “us”, “we” or “our”) is committed to protecting the privacy of personally identifiable information provided to us or that we may collect. This Privacy Policy describes: (1) the types of information we may collect from you or that you may provide when you visit or otherwise interact with our website, https://www.goodehealth.com, and mobile or tablet applications (collectively, the “Site”) or use any of our services (“Services”); and (2) how such information may be used and/or disclosed by us.

If you do not agree with Goode Health’s policies and practices, you may choose not to use the Site and our Services. By accessing and/or using the Site or our Services, you accept and agree to the terms of this Privacy Policy. We may make changes to this Privacy Policy from time to time. All changes will be posted at https://www.goodehealth.com. Your continued use of this Site or our Services after the Privacy Policy has changed will signify your acceptance of those changes.

This Site and our Services are only intended for persons who are 18 years of age or older. If you are under the age of 18, you are prohibited from using any of the 'Track My Health'  Services. This includes our Goode Health Dashboard and our Nutritional Assessment.  We will not knowingly allow anyone under the age of 18 to provide us with Personal Information, as defined below. In the event we learn that we have collected personal information from a child under the age of 18, we will use our best efforts to remove and delete that person’s information as quickly as possible. COLLECTION OF INFORMATION

Information You Provide: To use our Site or be considered for our Services, you may be required to provide personally identifiable information (collectively, “PII”) when you: (1) register to use the Site, (2) subscribe or purchase our Services, or (3) or otherwise communicate with us through our Site or via email. PII includes, but is not limited to, your name, mailing address, email address, telephone number, household members’ names; children’s full names; gender; ethnicity; birthdates; social security numbers; and financial information. In addition, you may share, and we may collect, certain health and medical information with your prior authorization in connection with the Services.

Information Collected Automatically: We may also collect certain non-identifiable, anonymized, and/or aggregated information that cannot be used on its own to identify you personally (collectively, “non-PII”). Non-PII may be collected automatically when you use or interact with our Site or services. Non-PII may include, but not be limited to, the type of computer or device you use to access our Site, the internet protocol address of your computer or device, your operating system, your internet browser type, location information, and information relating to the preferences you select and actions you take on our Site. The PII and non-PII we collect may be used without limitation: (1) to provide you with access to our Site and ensure our Site’s functionality; (2) to provide information, products or Services to you; (3) to verify your identity and ensure the security of your account; (4) to administer your account and provide you with notices about your account; (5) to fulfill or enforce contractual obligations; or (6) in any other way with your consent.

We may also use your information to send you certain advertisements or promotional offers from Goode Health or from third parties that may be of interest to you. INFORMATION SHARING

We may share PII and non-PII collected through our Site and Services with our subsidiaries, affiliates and other third-party providers who need your information in order to provide services to us or on our behalf. In addition, we may share such information with business partners who are contractually obligated to protect your information.

We may also share aggregated and de-personalized information with third parties. Any aggregate information we share in this context will not contain PII that identifies you. Third parties receiving such information may include your employer (with your consent as part of our employee wellness service) and other third parties to analyze how our Site and Services are used, to analyze the demographics of our user base, to deliver targeted advertising about other products and Services, and to provide or facilitate our Services (e.g., without limitation, maintenance services, database management, web analytics and improvement of features to our Services). No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

 

INFORMATION SHARING FOR LEGAL PURPOSES

We may need to disclose certain information to comply with a legal requirement, such as a law, regulation, court order, subpoena, or search warrant, in the course of a legal proceeding or in response to law enforcement or other governmental agency requests, to enforce the terms or conditions of agreements we enter into with you, or when we believe that disclosure is otherwise necessary to protect the our rights, property, or safety of Goode Health or others. In addition, if there is a change of control in our business (whether by merger, sale, or otherwise) or a sale or transfer of its assets, your PII and/or non-PII could be sold or transferred as part of that transaction.

You acknowledge that Goode Health is located in the United States of America ("U.S.") and will process and store your information in the U.S., and that as a result, U.S. governments, courts or law enforcement or regulatory agencies may be able to obtain disclosure of your information through the laws of the U.S. If you reside outside the United States your PII and non-PII will be transferred, processed and stored in the U.S. under U.S. privacy standards.

ADDITIONAL INFORMATION FOR CALIFORNIA RESIDENTS

California Consumer Privacy Act of 2018 (“CCPA”) Rights. Residents of California may have the following rights:

  1. Right to Access Your Personal Information. You may request access to the categories and specific pieces of personal information that we collected about you through our Site and our Services.
  2. Right to Deletion. Subject to certain exceptions, you may ask us to delete the personal information we collected about you through our Site and our Services.
  3. Right to Disclosure. You may request to receive additional details about the sources from which we collect information, the reasons we collect and share information, and the types of third parties with which we share the personal information we collected about you through our Site and our Services.
  4. Right to Opt Out of Sales. Under CCPA law, certain types of sharing of personal information may constitute a “sale” of your personal information. We do not sell the personal information we collected about you through our Site and our Services.

Shine the Light California Rights (CA Civil Code §1798.83). Residents of California who use our Site or our Services primarily for personal, family or household purposes may request a list of third parties to which certain personal information (as defined by applicable California law) obtained through our Site or our Services during the preceding year for those third parties’ direct marketing purposes. For such requests, you must put the statement “Your California Privacy Rights” in the body of your request, as well as your name, street address, city, state, and zip code. In your request, you need to attest to the fact that you are a California resident and provide a current California address for our response.

 

DATA SECURITY

We use industry-standard encryption technologies when transferring and receiving your information. You can check whether your connection is using encryption technologies by using the functions in your browser to show whether the webpage you are visiting is being delivered by “https.” We have also implemented other technical, physical and administrative security measures that protect against the loss, misuse, or alteration of information that we have collected from you. However, any information you share in public areas may be viewed by any user of the Site.

Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, the security of your data is a shared responsibility and no security system can prevent all potential security breaches. You acknowledge and agree that your transmission of PII and non-PII is performed by you at your own risk. You further acknowledge and agree that Goode Health is not responsible for any circumvention of the privacy settings or security measures that are contained on our Site or implemented in conjunction with our Services.

 

NOTICE OF CHANGES TO OUR PRIVACY POLICY

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy on our Site. All changes are effective immediately upon posting to our Site. Your continued use of this Site following a change in the Privacy Policy represents your consent and agreement to the new Privacy Policy to the fullest extent permitted by law. It is your responsibility to periodically visit our Site to review this Privacy Policy for any changes to it.

 

GOVERNING LAW

Goode Health is located in the state of Connecticut, United States of America. If you are accessing our Site or the Services from any location outside of the United States of America or with regulations or laws governing personal data collection, use, or disclosure that differ from the laws of the United States of America, be aware that you are transferring personal information to the United States of America and that the processing, storage, use and disclosure of that information will be subject to the domestic laws of the United States of America. You agree that any dispute relating to this Privacy Policy or the collection or use of your information will be resolved according to the laws of the state of Connecticut, without regard to conflict of law rules. Venue for such dispute shall be exclusively in a court of competent jurisdiction located in Fairfield County, Connecticut, and you agree to the personal jurisdiction of such courts.
